Terms and conditions for processing of personal data

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119/1) (hereinafter referred to as “GDPR”), you are hereby notified about the following:

  1. The Controller of your personal data is: MESSAGE HOUSE AGENCJA PR MACIEJ GAJEWSKI with the registered office at Warsaw (01-557), ul. Kazimierza Brodzińskiego 5 lok. 1, NIP taxpayer identifier: 5251628543, REGON business register number: 002018932.
  2. Your personal data, including but not limited to e-mail address, name and surname, and telephone number, will be processed for the purpose of replying to enquiries, sending material and information in accordance with messages sent to the Controller, and conducting communications.
  3. The legal basis for the processing of your personal data is your freely given consent, pursuant to Article 6.1(a) of GDPR.
  4. The personal data referred to in Paragraph 2 hereby have been obtained directly from yourself.
  5. The submission of your e-mail address is voluntary but also necessary for pursuit of the goal referred to in Paragraph 2 herein. The disclosure of other personal data is voluntary but not necessary for pursuit of the goal referred to in Paragraph 2 herein.
  6. The personal data can be shared with parties working with Data Controller – in accordance with contracts entered into with said parties and pursuant to the provisions of applicable laws on protection of personal data – including, but not limited to Data Controller’s personnel and third-party entities supplying IT, legal and consulting services. Your personal data may also be shared with entities and institutions authorised to process personal data pursuant to applicable laws.
  7. Your personal data will be stored:
    7.1.  throughout the period necessary to reply to an enquiry;
    7.2.  for purposes of the legitimate interests pursued by the Controller – to establish, exercise or defend legal claims – until such claims expire statutorily (Article 6.1(f) of GDPR).
  8. Your personal data will not be shared outside of the European Economic Area and will not be shared with international organisations.
  9. You have the right to request from the Controller access to and rectification or erasure of personal data or restriction of processing concerning yourself or to object to processing as well as the right to data portability. To the extent of personal data processed pursuant to Article 6.1(a) of GDPR, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal (Article 13.2(c)).
  10. Your personal data will be subject to processing other than by automated means.

  12. Pursuant to Article 6.1(d) of GDPR you have the right to complain to the Head of the Office for Protection of Personal Data (national data protection supervisory authority), should you find the processing of your personal data to infringe GDPR.
